Welcome to ROCNUBI AI COMPANY. These Terms of Service ("Terms") govern your access to and use of Muse AI Image. By accessing or using our service, you agree to be bound by these Terms. If you do not agree, do not use the service.

Use of the Service

Muse AI Image provides AI-powered tools, including AI music and audio generation, and related services. You agree to use the service in compliance with all applicable laws and regulations.

Eligibility

You must be at least 13 years old (or 16 in the EEA / UK) to use the service. By using Muse AI Image you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

User Accounts and Registration

All software, designs, infrastructure, branding, and underlying materials provided through Muse AI Image are owned by ROCNUBI AI COMPANY or its licensors and are protected by applicable intellectual property laws.

• You do not obtain ownership of the underlying technology, platform, or intellectual property used to provide Muse AI Image.
• You retain rights to content you lawfully create or upload, subject to the licenses and permissions required for us to operate the service.
• You grant ROCNUBI AI COMPANY a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and transmit your content solely to the extent necessary to provide and improve the service.

AI-Generated Content

Muse AI Image uses third-party machine learning models to generate audio and other media based on your input. Please note:

• You are responsible for the prompts and inputs you submit and for the use you make of the generated outputs.
• To the extent permitted by applicable law, the rights to outputs you generate are assigned to you, subject to the license you grant us above and subject to any third-party rights that may apply (for example, where outputs incorporate copyrighted, trademarked, or personality rights of others).
• You must not use the service to imitate a specific identifiable artist or person without authorization, to infringe copyright, to create deepfake content, or to generate content that violates applicable law.
• AI outputs may be inaccurate, offensive, or otherwise unsuitable. They are provided without warranty.

Prohibited Activities

You agree not to:

• Access, copy, distribute, or exploit the service in any unauthorized manner.
• Resell or redistribute the service or generated outputs in violation of these Terms or applicable law.
• Interfere with the security, stability, or proper functioning of Muse AI Image.
• Use the service for illegal, abusive, infringing, or unauthorized purposes, including harassment, child sexual abuse material, hateful content, fraud, or malware.
• Attempt to bypass usage limits, access controls, or security mechanisms.
• Use automated means to scrape, mirror, or extract data from the service except as expressly permitted.

Privacy and Data Collection

Our collection, use, and sharing of personal information is described in our Privacy Policy, which is incorporated by reference into these Terms.

Advertising

Free portions of Muse AI Image may display third-party advertising, including ads served by Google AdSense and other certified advertising networks. By using free portions of the service, you acknowledge and agree that:

• Advertising helps support continued availability of the service for non-paying users.
• We do not endorse, and are not responsible for, the content or accuracy of third-party advertisements.
• You may opt out of personalized advertising as described in our Privacy Policy.
• Paying subscribers are not shown advertising.

Pricing and Payments

• Purchases are final except where refunds are required by law or expressly stated otherwise.
• Prices and plan features may change from time to time.
• You agree to pay charges associated with your selected plan or usage.
• Payments are processed by our payment provider (Stripe). Their terms and privacy policy also apply to payment transactions.

Termination

We may suspend or terminate access to the service at our discretion if we believe you have violated these Terms or created risk for the service, other users, or third parties. You may terminate your account at any time by contacting us.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that generated outputs will meet your expectations.

Limitation of Liability

To the fullest extent permitted by law, ROCNUBI AI COMPANY will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the service. Our aggregate liability for any claim arising out of these Terms or the service will not exceed the amount you paid to us for the service in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars (USD 100), whichever is greater.

Indemnification

You agree to indemnify and hold harmless ROCNUBI AI COMPANY, its affiliates, and their respective officers, directors, employees, and agents from claims, damages, losses, liabilities, and expenses arising from your use of the service, your content, or your violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws applicable to the operating entity behind ROCNUBI AI COMPANY, without regard to conflict-of-law rules.
